Terms of Service

These Terms of Service are an agreement between you and Simple Safe Technologies LLC, doing business as Infinity Smart Living ("Infinity," "we," "us," "our"), governing your use of this website and your purchase of smart home design and installation services. By using the site, requesting a consultation, or placing an order, you agree to these Terms. If you do not agree, do not use the site or place an order.
1. About these Terms
These Terms govern your use of infinitysmartliving.com (the "Site") and your purchase of smart home design and installation services from Infinity. By using the Site, requesting a consultation, or placing an order, you agree to these Terms. If you do not agree, do not use the Site or place an order.
2. Who we are and what we do
Infinity designs custom Amazon Alexa smart home plans for homeowners in South Florida. Our services include:
- A free virtual consultation and a custom floor plan built around how you live.
- The sale of smart home packages consisting of design, equipment, and installation.
- Installation of that equipment, with the regulated electrical work performed by a licensed local electrician under contract for your project.
Infinity is a full-service smart home automation company. Infinity is the party you contract with for your package, and Infinity collects payment for the package. On every project, a licensed local electrician is under contract for the regulated electrical work and is the licensed party responsible for that work, holding the license required for it, carrying its own insurance, and performing it in compliance with applicable Florida law and building codes. Infinity does not perform the regulated electrical work with its own employees. Infinity is not a lead-referral or matchmaking service, and you do not contract separately or directly with the electrician or any installer on your own. Infinity remains responsible to you for the package it sells and for putting a qualified licensed electrician under contract for the regulated electrical work.
3. Not a security, monitoring, or life-safety system
Your smart home system is a convenience and home-automation system. It is not designed or intended to function as a security, monitoring, life-safety, or emergency-response system, and you agree not to rely on it for those purposes. Connected devices depend on power, internet connectivity, third-party services, and your own configuration, any of which may be interrupted. Infinity is not responsible for any loss arising from reliance on the system for a purpose it is not designed to serve.
4. Consultation and floor plan
The virtual consultation and custom floor plan are provided at no charge and carry no obligation to purchase. The floor plan is a design proposal based on the information you provide and is not a guarantee of final scope, equipment, or price, which are confirmed in your written order.
5. Placing an order
Your order is confirmed when you accept a written quote or order form specifying the package, equipment, scope, and price, and you authorize the applicable payment. Equipment models and quantities may be substituted with items of equal or greater function if a listed item becomes unavailable.
6. Pricing and payment
Prices are as stated in your written quote or order form. You agree to pay the amounts and on the schedule set out there. Applicable taxes are your responsibility. Infinity collects payment for the package it sells to you.
7. Installation and the licensed local electrician
Infinity arranges the installation of your package and puts a licensed local electrician under contract for the regulated electrical work. That electrician is independent, holds the license required for the work, carries its own insurance, and is the licensed party responsible for performing the regulated electrical work in compliance with applicable law and building codes. Infinity is responsible to you for the package under Section 9 and for putting a qualified licensed electrician under contract. Responsibility for the regulated electrical work itself, including its workmanship and code compliance, rests with the licensed electrician that performs it. You agree to provide safe and reasonable access to your home and to the areas where work is performed, and to ensure the work areas are ready on the scheduled date.
8. Equipment and manufacturer warranties
Your package includes third-party equipment (for example smart thermostats, smart switches and dimmers, Amazon Echo devices, smart entry hardware, video doorbells, and cameras). This equipment is covered by the applicable manufacturer warranties, which pass through to you. Infinity does not manufacture this equipment and makes no warranty beyond the limited warranty in Section 9 and the manufacturers' own warranties.
9. Our limited warranty
The licensed local electrician under contract for your project is responsible for the workmanship and code compliance of the regulated electrical work and provides its warranty for the work it performs. Infinity warrants that it will put a licensed electrician under contract to perform that work, and if you notify us of a workmanship issue within the warranty period stated in your order, Infinity will arrange for it to be corrected under the responsible electrician's warranty, at no additional labor charge covered by that warranty. This warranty does not cover damage from misuse, unauthorized changes, power or connectivity interruptions, third-party service changes, or normal wear. Except as stated here, in the electrician's warranty, and in any manufacturer warranty, the package is provided "as is" to the fullest extent permitted by law.
10. 30-day guarantee
Infinity offers a 30-day guarantee as described in your order. The specific refund amount, deductions, and conditions are set out in your written order and in the guarantee terms in effect at the time of purchase.
11. Cancellation and changes
You may cancel before installation begins as described in your order. Changes to scope after your order is confirmed may change the price and schedule. Once equipment is installed, cancellation is governed by Section 10.
12. Your responsibilities
You are responsible for: providing accurate information about your home, having a compatible internet connection, maintaining your own accounts and passwords for third-party services (including your Amazon account), and keeping the system's software and your devices up to date. You confirm you are at least 18 years old and are the homeowner or are otherwise authorized to approve this work at the property.
13. Communications consent
By providing your phone number and submitting a form, you agree that Infinity and its representatives may contact you by phone, text, and email about your consultation and order, including by automated means, at the number provided. Consent is not a condition of purchase. Message and data rates may apply. You may opt out at any time as described in our Privacy Policy.
14. Amazon Alexa and third-party services
Your system uses Amazon Alexa and other third-party products and services, each governed by its own terms and privacy policies. Infinity is not responsible for third-party services, their availability, or changes they make. "Amazon," "Alexa," and "Echo" are marks of their respective owners, and Infinity is not affiliated with or endorsed by them.
15. Limitation of liability
To the fullest extent permitted by Florida law, Infinity's total liability arising out of or relating to your package or these Terms will not exceed the amount you paid for the package. Responsibility and liability for the regulated electrical work itself rest with the licensed local electrician under contract for it, as described in Sections 2, 7, and 9. Infinity is not liable for indirect, incidental, special, or consequential damages, or for any loss arising from reliance on the system for a security, monitoring, life-safety, or emergency purpose as described in Section 3.
16. Indemnification
You agree to defend, indemnify, and hold harmless Simple Safe Technologies LLC, its DBA Infinity Smart Living, and its members, managers, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: your use or misuse of the system; your breach of these Terms; your provision of inaccurate information about your home or authority to approve work; your violation of any law or the rights of any third party; or any condition of your property that is not disclosed to us or to the licensed electrician. This obligation survives completion of your order and termination of these Terms.
17. Dispute resolution, arbitration, and governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
Any dispute arising out of or relating to these Terms or your package will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, seated in Broward County, Florida. You and Infinity waive the right to a jury trial and the right to participate in any class, collective, or representative action. Nothing in this section prevents either party from seeking relief in small claims court for a qualifying claim. This section does not waive any right that cannot be waived under applicable law.
18. Independent contractors
The licensed local electrician under contract for the regulated electrical work is an independent contractor, not an employee, partner, or agent of Infinity. Infinity's obligation with respect to that work is to put a qualified licensed electrician under contract for it, as described in Sections 2, 7, and 9.
To the fullest extent permitted by law, Infinity is not responsible for the independent acts or omissions of the licensed electrician beyond its duty to put a qualified licensed one under contract.
19. No personal liability
Your agreement is with Simple Safe Technologies LLC, doing business as Infinity Smart Living, and not with any individual. To the fullest extent permitted by law, no member, manager, officer, employee, or agent of the company has any personal liability under these Terms or in connection with your package.
20. Force majeure
Infinity is not responsible for any delay or failure to perform caused by events beyond its reasonable control, including supply shortages, shipping delays, third-party service outages, utility or internet interruptions, labor shortages, weather, or acts of government.
21. Intellectual property
The floor plans, designs, proposals, and other materials Infinity prepares for you are the property of Infinity until your order is paid in full, and the underlying templates, methods, and know-how remain Infinity's property at all times. The Site and its content are owned by Infinity or its licensors and may not be copied or reused without permission.
22. General
If any provision of these Terms is found unenforceable, the rest remain in effect and the unenforceable provision will be limited to the minimum extent necessary. These Terms, together with your written order and our Privacy Policy, are the entire agreement between you and Infinity and supersede any prior understanding. Infinity may assign these Terms; you may not assign them without our consent. Our failure to enforce a provision is not a waiver of it. There are no third-party beneficiaries to these Terms. Section headings are for convenience only.
23. Changes to these Terms
Infinity may update these Terms. The version in effect when you place your order governs that order. Continued use of the Site after changes are posted means you accept the updated Terms.
