Terms of Service

These Terms of Service are an agreement between you and SimpleSafe Technologies LLC, doing business as Infinity Smart Living ("Infinity," "we," "us," "our"), governing your use of this website and your purchase of smart home design and installation services. By using the site, requesting a consultation, or placing an order, you agree to these Terms. If you do not agree, do not use the site or place an order.

1. About these Terms

These Terms govern your use of infinitysmartliving.com (the "Site") and your purchase of the products and technology services that Infinity itself offers. They govern Infinity’s own transaction only. They do not govern, and do not incorporate, any agreement you make with a licensed contractor.

Requesting a consultation, submitting a form, or receiving a free concept does not create a purchase obligation and is not agreement to any purchase terms. You accept these Terms for a purchase only when you affirmatively accept a written Infinity order that identifies the version of these Terms applying to it.

2. Who we are and what we do

Infinity provides smart-home technology consultation, an illustrative room-by-room smart-home concept, candidate product recommendations, separately priced equipment where offered, and only the non-regulated device and app configuration expressly listed in an Infinity order.

Infinity Smart Living is not an electrical, limited-energy, HVAC, alarm, or other licensed contractor. Infinity does not offer, contract for, negotiate, price, collect payment for, schedule, supervise, perform, accept, or warrant regulated work, and does not obtain permits.

If your project needs regulated work, you independently select and contract directly with an appropriately Florida-licensed contractor. That contractor independently determines feasibility, permits, scope, price, schedule, invoicing, payment, performance, supervision, warranty, and claims for its own work. You may use any appropriately licensed contractor you choose.

3. Not a security, monitoring, or life-safety system

Your smart home system is a convenience and home-automation system. It is not designed or intended to function as a security, monitoring, life-safety, or emergency-response system, and you agree not to rely on it for those purposes. Connected devices depend on power, internet connectivity, third-party services, and your own configuration, any of which may be interrupted. Infinity is not responsible for any loss arising from reliance on the system for a purpose it is not designed to serve.

4. Consultation and the room-by-room smart-home concept

The virtual consultation and the room-by-room smart-home concept are provided at no charge and carry no obligation to purchase. The copy of the concept Infinity prepares for you is yours to keep, whether or not you place an order.

The concept is illustrative only. It is not a wiring diagram, electrical, HVAC or alarm design, construction or permit plan, installation specification, or contractor bid. It contains no circuit, load, panel, neutral-wire or C-wire determinations, no code or permit conclusions, and no contractor scope or price. Any regulated work must be independently evaluated, scoped, and priced by a contractor whose active Florida license covers the specific task.

5. Placing an order with Infinity

An Infinity order covers only the products and technology services Infinity offers. Your order is confirmed when you affirmatively accept a written Infinity order or quote identifying the items, scope, and price, and you authorize the applicable payment. Equipment models and quantities may be substituted with items of equal or greater function if a listed item becomes unavailable.

Any contractor agreement is entirely separate. Infinity does not prepare, negotiate, accept, alter, or administer it, and does not bind you or the contractor.

6. Pricing and payment

Prices are as stated in your written Infinity order. You agree to pay the amounts and on the schedule set out there. Applicable taxes are your responsibility. Infinity collects payment only for what Infinity itself sells.

Infinity does not quote, mark up, combine into a package total, invoice, or collect payment for a contractor’s regulated work. The contractor you select bills you directly under its own agreement.

7. Regulated work and licensed contractors

Regulated work is outside Infinity’s scope. If your project needs it, you select and contract directly with an appropriately Florida-licensed contractor, and that agreement is between you and that contractor.

Infinity does not direct means or methods, obtain permits, supervise, inspect, accept completed trade work, or warrant a contractor’s work, and has no authority to bind you or the contractor to anything.

8. Equipment and manufacturer warranties

Equipment sold by Infinity is covered by the applicable manufacturer warranties, which are provided by the manufacturer and governed by the manufacturer’s own terms. Infinity is not the warrantor of that equipment. Registration, claim handling, and remedies follow the manufacturer’s process.

9. Warranties

Infinity does not provide a product warranty or a configuration-service warranty under these Terms. Manufacturer warranties are governed by the manufacturer. A contractor’s work is warranted by that contractor under its own agreement.

If Infinity offers a warranty on anything it sells, that warranty and its terms will be stated in your written Infinity order and made available to you before you purchase. No warranty is created by these Terms or by anything on this Site.

10. Returns and refunds

Return and refund terms, where they apply, are stated in your written Infinity order and made available to you before you purchase. These Terms do not create a return or refund right on their own. Nothing here limits any right you have under Florida or federal law.

11. Changes to your order

Changes to the items or scope in your Infinity order after it is confirmed may change the price. Any change is effective when reflected in an updated written Infinity order that you accept.

Cancellation terms, where they apply, are stated in your written Infinity order. Nothing here limits any cancellation right you have under Florida or federal law.

12. Your responsibilities

You are responsible for: providing accurate information about your home, having a compatible internet connection, maintaining your own accounts and passwords for third-party services (including your Amazon account), and keeping the system's software and your devices up to date. You confirm you are at least 18 years old and are the homeowner or are otherwise authorized to approve this work at the property.

Your system uses Amazon Alexa and other third-party products and services, each governed by its own terms and privacy policies. Infinity is not responsible for third-party services, their availability, or changes they make. "Amazon," "Alexa," and "Echo" are marks of their respective owners, and Infinity is not affiliated with or endorsed by them.

15. Limitation of liability

To the fullest extent permitted by Florida law, Infinity’s total liability arising out of or relating to an Infinity order or these Terms will not exceed the amount you paid Infinity under that order.

Responsibility and liability for regulated work rest with the licensed contractor that performed it, under that contractor’s own agreement with you.

Nothing in this section limits any liability that cannot be limited under Florida or federal law.

16. Indemnification

You agree to defend, indemnify, and hold harmless SimpleSafe Technologies LLC, its DBA Infinity Smart Living, and its members, managers, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: your use or misuse of the system; your breach of these Terms; your provision of inaccurate information about your home or authority to approve work; your violation of any law or the rights of any third party; or any condition of your property that is not disclosed to us or to the licensed electrician. This obligation survives completion of your order and termination of these Terms.

17. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.

These Terms contain no arbitration agreement, no class-action waiver, and no jury-trial waiver. You keep every right you would otherwise have to bring a claim in court.

18. Independent contractors

A licensed contractor you engage for regulated work is an independent business, not an employee, partner, agent, or subcontractor of Infinity, and Infinity is not that contractor’s prime, general, or managing contractor.

Infinity has no obligation to find, select, contract, supervise, or stand behind any contractor. To the fullest extent permitted by law, Infinity is not responsible for the acts or omissions of any contractor you engage.

19. No personal liability

Your agreement is with SimpleSafe Technologies LLC, doing business as Infinity Smart Living, and not with any individual. To the fullest extent permitted by law, no member, manager, officer, employee, or agent of the company has any personal liability under these Terms or in connection with your Infinity order.

20. Force majeure

Infinity is not responsible for any delay or failure to perform caused by events beyond its reasonable control, including supply shortages, shipping delays, third-party service outages, utility or internet interruptions, labor shortages, weather, or acts of government.

21. Intellectual property

The copy of the room-by-room smart-home concept Infinity prepares for you is yours to keep, whether or not you place an order. Infinity retains ownership of its underlying templates, methods, processes, and know-how. The Site and its content are owned by Infinity or its licensors and may not be copied or reused without permission.

22. General

If any provision of these Terms is found unenforceable, the rest remain in effect and the unenforceable provision will be limited to the minimum extent necessary. These Terms, together with your written order and our Privacy Policy, are the entire agreement between you and Infinity and supersede any prior understanding. Infinity may assign these Terms; you may not assign them without our consent. Our failure to enforce a provision is not a waiver of it. There are no third-party beneficiaries to these Terms. Section headings are for convenience only.

23. Changes to these Terms

Infinity may update these Terms. The version in effect when you place your order governs that order. Continued use of the Site after changes are posted means you accept the updated Terms.
